Comcast, Google Can Publish Users’ Email Contents | Service Providers | E-Commerce Times

Comcast’s Terms of Service for its Xfinity Internet service gives it, its agents, suppliers and affiliates the right to “reproduce, publish, distribute and display” the content worldwide. It also lets third parties copy, republish or distribute material posted or transmitted using Xfinity Internet. This would include confidential information sent by a company employee or an independent contractor.

For the Defense Department to recapture its broad technological advantage over the rest of the world, it can’t be afraid to fail once in a while.

Under that specific direction from Congress, the Pentagon detailed a plan to shake-up its Acquisition, Technology and Logistics (AT&L) office in the Office of Secretary of Defense with two main goals in mind: Accelerate the development and acquisition of cutting edge technology, and change the mindset of those buying, developing and managing technology.

Yesterday, the Defense Department released the long-awaited game plan for how it plans to pull off one of the largest Pentagon reorganizations in decades: splitting the office of the undersecretary of Defense for Acquisition, Technology and Logistics in two, and standing up the new position of chief management officer. Andrew Hunter served as a senior official in the AT&L organization during the Obama administration. Now a senior fellow in the international security program at the Center for Strategic and International Studies, he shares some initial takeaways from DoD’s 31-page report on Federal Drive with Tom Temin.

FAR 15.306 describes a spectrum of exchanges that may take place between a contracting agency and an offeror during negotiated procurements. “Clarifications” is one end of the spectrum. Clarifications are limited exchanges, between the government and offerors, that may occur when award without discussion is contemplated. An agency may, but is not required to, engage in clarifications that give offerors an opportunity to clarify certain aspects of proposals or to resolve minor or clerical errors. Agencies have broad discretion as to whether to seek clarifications from offerors, offerors have no automatic right to clarifications regarding proposals, and such communications cannot be used to cure proposal deficiencies or material omissions, materially alter the technical or cost elements of the proposal, and/or otherwise revise the proposal.
