Proposed Legislation Would Requiring Publishing the Full Text of Government Contracts | PNWC’s Government Contracting Update

Last month, Senator McCaskill (MO) introduced the Contractor Accountability and Transparency Act of 2017. Despite its name, the only thing it requires is for the Government to post electronic versions of all contracts over $150,000 (the simplified acquisition threshold).

… machine readable, searchable copy of each covered contract entered into by a Federal agency after the date of the enactment … posted not later than 30 days after the agency enters into the contract.

Spring is Here – Prepare for ICE | PNWC’s Government Contracting Update

PNWC would like to remind all Government contractors of an important deadline – annual incurred cost submissions are due on June 30th (or six months after fiscal year end for contractors whose fiscal years do not coincide with calendar years). Preparation for this annual ritual, commonly referred to as “ICE” meaning “Incurred Cost Electronically” after DCAA’s Excel-based interpretation of the requirements of FAR 52.216-(d)(2)(iii), should begin now.

Government prime contractors have the responsibility of managing their purchasing program. DCMA (Defense Contract Management Agency) and specifically DCMAs’ CPSR (Contractor Purchasing System Review) teams is responsible for evaluating the contractor’s overall purchasing system to ensure that it is efficient and effective in the expenditure of Government funds and in compliance with contract requirements.

Allegations that Senior DOE Official Received Kickbacks from Contractor | PNWC’s Government Contracting Update

A contractor employee assigned to work at the FBI Headquarters as a database administrator pleaded guilty of making false statements to FBI agents in connection with an official investigation. This individual worked at FBI Headquarters for about three and a half years between 2011 to 2014. Prior to that, way back in 2004, he was somehow involved with the Department of Energy where he facilitated transactions between a senior DOE official and a private company doing business with DOE.

RIP – Fair Pay and Safe Workplaces Regulations | PNWC’s Government Contracting Update

Yesterday the President signed into law H.J.Res 37 which repeals the Fair Pay and Safe Workplaces regulations, which was based on an Executive Order from the prior President.
