FY 2019 NDAA – Government Contracts Legal Forum

On Monday, August 13, 2018, President Trump signed into law the H.R. 5515, the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (FY 2019 NDAA), the earliest an NDAA has been signed in over a decade.  The FY 2019 NDAA includes several provisions relevant to contractors, including replacing the definition of “commercial item” with “commercial product” and “commercial services,” discouraging the use of lowest price technically acceptable contracting, and a clause designed to accelerate payments to small businesses.

GSA held an Industry Day August 7 to introduce the procurement, which as they reiterated, is early in the process and industry feedback is welcome. The program is generating a lot of attention with more than 230 companies attending Industry Day.

NDAA FY 2019 Signed into Law with Strong Bipartisan Support | Government Contracts Blog

Today, President Trump signed into law the John S. McCain National Defense Authorization Act for Fiscal Year 2019(H.R. 5515). The bill passed both houses with broad bipartisan support. The House approved the bill by a vote of 359 to 54 and the Senate by a vote of 87 to 10. The law authorizes FY 2019 appropriations and sets forth policies for Department of Defense programs and activities, including military personnel strengths.

Agencies gear up for end-of-the-fiscal-year spending rush – FederalNewsRadio.com

Defense Agencies Continue Awarding Contracts to Suspended Firms, Report Finds – Contracting – GovExec.com

At least nine major contractors, working primarily for defense-related agencies, have benefited from waivers under a 1981 law that allows federal officials to override the firms’ suspensions for such misconduct as fraud, bribery and theft.
