GAO: Where RFP Requirements Clearly Not Met, Protest Costs Reimbursable – SmallGovCon

As Koprince Law attorneys have discussed in depth, GAO will in some instances award costs for a clearly meritorious protest where an agency does not take corrective action before the due date for the agency report. But what are the standards for a “clearly meritorious” protest?

It’s instructive to look at a recent GAO decision that reviewed protest grounds dealing with past performance evaluation and a requirement that the Army be able to set up the proposed product within 60 seconds.

Last Tuesday, the Senate passed its version of the Fiscal Year 2019 NDAA (National Defense Authorization Act). Its called the John S. McCain National Defense Authorization Act for Fiscal Year 2019. Now its on to negotiations with members of the House of Representatives to create a compromise bill to send to the President.

Part 1: Improving Solicitations

At Red Team Consulting, we see hundreds of RFPs every year. We review solicitations across the Department of Defense and from nearly every single Civilian Department. These include standalone single-award contracts that range in size from $5M to over $500M, to multiple-award IDIQ contracts valued at over $20B. Most of these RFPs are very similar in how they are structured, organized, and evaluated. Because FAR guidelines prescribe what the government requests, essentially all RFPs ask for the same information. The challenge is not what the government asks for; it is matching their expectation for what they will receive with how industry interprets their instructions.
