The government contracting industry has experienced increasingly rapid growth over the past three years. Among firms in the Government Contracting segment of the 2018 High Growth Study, the median annual growth rate for government contracting firms in 2017 was 13.3 percent, an increase of more than 50 percent over 2016 (see Figure 1). In contrast, the growth rate for firms that do not sell any government services fell by two percentage points to 9.1 percent.

The Justice Department just announced that a Federal Grand Jury indicted three men with a 12-year fraud involving over $200 million in Government contracts – contracts intended for small business but actually performed by large businesses. This latest case is hardly unique. We’ve been reporting for some time about large companies using using straw owners to get work intended for small businesses. What is surprising about this case is the magnitude ($200 million) and its duration (12 years).

In 2014, the Army awarded a contract to a company called Protec for maintenance, inspection, and repair of fire alarm, fire suppression, and evacuation systems in Germany. In 2015, the contracting officer posted an unsatisfactory report in CPARS (Contractor Performance Assessment Reporting System) and also refused to pay some of Protec’s invoices.

Army acquisition chief wants clearer lines on intellectual property

The Army’s top acquisition official said the government has a lot of work to do when it comes to how it treats vendors’ intellectual property. Among his top concerns: The Army needs to find new ways to conduct fair and open competitions without forcing companies to expose their best ideas to potential competitors, and ensure that it’s clear which IP is owned by whom.
