Changes to the Size and Socioeconomic Status Recertification Regime Lead to Questions and Confusion – Government Contracts Legal Forum

The Small Business Administration (SBA) has seemingly slipped a noteworthy change into a technical correction published in the Federal Register on March 26, 2018.  Indeed, this “technical correction” actually appears to be an attempt to overturn the impact of a decision that the Office of Hearing and Appeals (OHA) issued in January 2018 – In The Matter of: Analytic Strategies, Inc., No. VET-268 – which held that under SBA’s recertification rules, a SDVOSB maintains its size and socio-economic status for the life of the multiple-award contract unless a contracting officer requests recertification in connection with a specific task order.

Government Contracts Group Concludes Successful 34th Annual OOPS Event – Government Contracts Legal Forum

Last week, the Government Contracts Group wrapped up its 34th annual Ounce of Prevention Seminar, “Diving Into Uncharted Waters,” last week. The speaker panels featured Crowell & Moring lawyers from various practice groups, government officials—including GSA Administrator Emily Murphy—and in-house counsel, and focused on a variety of timely issues including False Claims Act enforcement, ethics and compliance, bid protests, cybersecurity and privacy, and international issues affecting government contractors. In Matter of: First Fin. Assocs., Inc., B-415713, Feb. 16, 2018, the Government Accountability Office (GAO) denied a protest filed by First Financial Associates, Inc. (FFA)  against an award by the Department of Homeland Security, U.S. Secret Service (DHS/USSS) to FEEA Childcare Services, Inc. (FEEA) for the administration of a childcare subsidy program.  FFA alleged that their proposal was not evaluated consistently with the RFP’s evaluation criteria regarding the protection of personally identifiable information (PII) incident reporting requirements.
