Navy makes more changes in biggest portion of NGEN recompetition

The Navy is signaling further delays in the release of a solicitation for a multibillion dollar recompetition of its largest IT contract after making another round of unexpected changes to its requirements.

On Tuesday afternoon, the Space and Naval Warfare Systems Command posted portions of another draft version of its request for proposals for the larger of two segments of the upcoming Next Generation Enterprise Network (NGEN) contract, known as Service Management Integration and Transport (SMIT).

What Happens When a Contractor Files for Bankruptcy?

It doesn’t happen frequently but contractor bankruptcy happens often enough to warrant a special contract clause that appears in every contract above the simplified acquisition threshold (currently set at $150 thousand). The Bankruptcy clause is found at FAR (Federal Acquisition Regulations) 52.242-13. and requires contractors entering into proceedings relating to bankruptcy, whether voluntary or involuntary, to furnish by certified mail (or electronic commerce method authorized by contract), written notification to the contracting officer responsible for administering the contract.

Court of Federal Claims Rejects Unsupported Decision to Cancel Solicitation – SmallGovCon

An agency ordinarily enjoys very broad discretion in its procurement-related decisions. This includes whether an agency will award a contract or, instead, cancel a procurement. Broad as this discretion is, however, an agency does not have carte blanche authority to cancel a procurement on a whim. As a recent Court of Federal Claims decision shows, an agency must support its decision with sufficient information, lest the cancellation decision itself be successfully protested.
